1. Agreement to Terms
By accessing or using the Noxly application, website, and associated AI services ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our Service.
2. The Early Access Program
Noxly is currently operating an "Early Access" program, granting select users unrestricted access to premium AI capabilities (including Noxly Pro and Deep Research models) free of charge.
- Program Modification: We reserve the right to modify, suspend, or terminate the Early Access program at any time.
- Future Monetization: While early adopters may receive legacy benefits, Noxly reserves the right to introduce usage caps, rate limits, or paid subscription tiers for specific features in the future.
3. Acceptable Use Policy
You agree not to use Noxly for any unlawful or abusive purpose. Specifically, you may not use our AI routing engine to:
- Generate, promote, or distribute illegal content, malware, or malicious code.
- Generate non-consensual explicit content, hate speech, or content designed to harass or harm others.
- Attempt to bypass, exploit, or reverse-engineer our API routing, usage limits, or security infrastructure.
- Submit sensitive Personally Identifiable Information (PII) or classified corporate secrets without appropriate authorization.
4. AI Output & Disclaimer of Accuracy
Artificial Intelligence is inherently probabilistic. The outputs generated by Noxly are provided for informational and creative purposes only.
- Hallucinations: The AI may occasionally produce inaccurate, misleading, or fabricated information. You are strictly responsible for verifying the accuracy of any output before relying on it.
- No Professional Advice: Noxly does not provide certified medical, legal, financial, or professional advice. Outputs should never replace consultation with a qualified professional.
5. Intellectual Property Rights
We respect your creative ownership. Under these Terms:
- Your Inputs & Outputs: You retain all rights and ownership to the text prompts you submit and the resulting outputs generated by the Service.
- Our Platform: Noxly retains all intellectual property rights to the application interface, routing architecture, custom algorithms, and brand assets.
6. Service Availability & API Limits
Noxly relies on third-party computing providers (e.g., NVIDIA, OpenRouter, Tavily). Consequently, we do not guarantee 100% service uptime. We reserve the right to dynamically rate-limit requests, throttle heavily active accounts, or temporarily disable specific models to protect the overall stability of the platform.
7. Limitation of Liability
To the maximum extent permitted by law, Noxly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; or (c) any content obtained from the Service.
8. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the date at the top of this policy and, in some cases, providing a notification within the app. Your continued use of Noxly after any changes constitutes your acceptance of the new Terms.
